Terms and Conditions as related to tour bookings

1. UNDERTAKING
1.1 Uthando (Love) South Africa undertakes to provide all services offered subject to the terms and conditions set out herein, which terms and conditions are accepted by the Traveler.
1.2 Uthando drivers and guides are trained and possess the required qualifications and documents.
1.3 All vehicles used by Uthando South Africa are safe and comply with relevant legislation and safety regulations.

2. DEFINITION
2.1 Uthando South Africa means: Uthando Social Development Projects, South Africa
2.2 Traveler means: Individuals, groups, companies or other legal persons using the services offered by Uthando South Africa.
2.3 Services means: The provision of philanthropic educational excursions and guiding services visiting community development projects and social entrepreneurs, which includes transportation and/or meals and/or any and all other travel services and activities as offered or provided by Uthando South Africa and Uthando South Africa’s community projects and entrepreneur partners and accepted by the Traveler as part of the booking agreed upon between all parties.

3. TERMS OF PAYMENT
3.1 On confirmation of services: full pre-payment of the quoted philanthropic educational excursion price is preferred to confirm the booking. A confirmation of booking is generated by Uthando South Africa immediately upon confirmation of the booking and sent to the Traveler.
3.2 Payment can be made online using the DPO Group South Africa credit card platform or direct into the Uthando South Africa bank account.
3.3 For bookings through tour operators or other tourism suppliers full payment is required at least 30 days prior to date of booking.
3.4 Uthando South Africa generally only runs one philanthropic educational excursion per day thus early pre-payment is of vital importance to secure the booking.
3.5 All prices and rates are quoted in ZA Rand. Payment in approved foreign currency will be accepted at the rate of exchange applied by the bankers of Uthando South Africa at the time of receipt of payment. Any shortfall resulting from exchange fluctuations will be for the account of the Traveler.
3.6 Payments may be deposited directly into the following bank account:

4. CANCELLATIONS
4.1. Cancellation before 15 days prior to date of booking Uthando South Africa will refund 100% of booking payment.
4.2. Cancellation within 15 days prior to date of booking Uthando South Africa will refund 50% of booking payment.
4.3 Cancellation within 5 days prior to date of booking no refund will be made to the Traveler.
4.4 ‘No shows’ will be charged 100% of the quoted tour price.

5. INSURANCE
Uthando South Africa carries comprehensive liability insurance details which can be made available on request.

6. INDEMNITY and LIMITED LIABILITY
6.1 Uthando South Africa is indemnified and held harmless against any and all claims, losses, damages and / or costs, howsoever caused, arising directly or indirectly from these terms and conditions and any philanthropic education excursions operated or organized by Uthando South Africa. Nothing in this Agreement shall operate so as to exclude or in any way limit the Travelers’ or Uthando South Africa’s liability for fraud, or for death or personal injury by either’s negligence or any other liability that may not be excluded or limited as a matter of law.
6.2 Uthando South Africa takes Travelers into township communities to visit community development projects and social entrepreneurs. Uthando South Africa guides will brief Travelers prior to the philanthropic educational excursion on the Uthando Code of Conduct and safety measures, however, neither Uthando South Africa nor their employees can be held responsible for any injury or accident while on excursions.
6.3 Uthando South Africa is a well established, highly reputable organization, firmly rooted in the communities that it visits, and in conjunction with all local partners every conceivable precaution is taken to ensure the safety and security of Travelers.
6.4 Uthando South Africa, their employees and partners shall not be responsible for and shall be exempt from any liability in respect of any loss, damage, injury, accident, delay or inconvenience to any person or their personal property whether the same shall arise from or be occasioned by the negligence of Uthando South Africa, their employees and partners and other persons indirectly in the employ or service of Uthando South Africa.
6.5 Uthando South Africa strongly recommend that Travelers take adequate personal travel insurance cover before departure from their home country.

6. JURISDICTION
The law of the Republic of South Africa shall govern the relationship between Uthando South Africa and the Traveler and the Courts of the Republic of South Africa shall have sole jurisdiction in respect of any claims and/or disputes which may arise between Uthando South Africa and the Traveler, or Agent.
